Repeal: "Freedom of Expression"

A resolution to repeal previously passed legislation.

Category: Repeal | Resolution: GA#30 | Proposed By: Imperium Anglorum General Assembly Resolution #30 “Freedom of Expression” (Category: Furtherment of Democracy; Strength: Mild) shall be struck out and rendered null and void.

The World Assembly,

Resolving that it is profoundly immoral to permit corporations and legal persons to lie to consumers,

Believing that society as a whole can have justifiable reasons to restrict expression for public safety and to prevent the consumption or publication of materials that would damage public health, social order, or needless antagonisation,

Seeing that society should have the ability to regulate adverts and their means of distribution, eg prohibiting tobacco advertisements from being shown on childrens' television channels or placing limits on where or what can be depicted in such advertising, and

Confident that there will be a scrambling of legislative efforts to replace this resolution with more appropriate legislation that permits society to protect itself, hereby:

Repeals GA c 30 "Freedom of Expression".

This repeal takes a look at the established WA resolution on Freedom of Expression and sets forth a few points on why it should be repealed and replaced with a better functioning resolution. The repeal proposal focuses on a seemingly ignored scenario by the original author: corporate entities and legal persons using Freedom of Expression to justify lying to consumers and clients. The original resolution does not have any protections against this, and in a way with the clause "Requires member states to respect and uphold this right in all available media to all individuals under their jurisdiction;" seems to expressly facilitate this scenario. The repeal proposal does stress that the author is confident in a "scrambling of legislative efforts to replace this resolution with more appropriate legislation," and it's my opinion that a future proposal could cover this loophole in a fitting manner. Therefore, it is my recommendation that Her Adorable Owlishness votes aye to this proposal.

I shall repeat what I posted in the NS forums earlier:

Having looked at this bill as well as GA #30, Derumia finds this repeal unnecessary. While the author may have honourable intentions, we are of the view that GA #30 already permits nations to carry out actions stated in clause 2 and 3. There are no legal provisions that specifically states that corporations are people. Speech by corporations is therefore not protected. They are able to be regulated with the interests of society in mind, which is what the purpose of this bill is. Repealing GA #30 and afterwards passing a replacement would only serve to waste everybody's time and delay other genuine bills from being voted on in the WA. Hence, we are opposed to this repeal.

I see somebody has posted a legality challenge under honest mistake so lets see how it goes
