[Defeated] Amendment to CAIN treaty

Below is (unless I have missed things) a full mark-up of the changes from the original treaty to the proposed version:
Coalition Against the Ideology of Nazism (CAIN)

We, the undersigned governments; are mindful of the impact Nazism has on the community we all share, devoted to combating scientific racism, appalled by the glorification of Nazi Germany, determined . We are committed to overcomeing gameplay differences , and committedto makinge the NationStates community more accessible; do hereby. In pursuit of these goals, we establish and join the Coalition Against the Ideology of Nazism, herein referred to as "CAIN",("CAIN"), and agree to recognize and adhere to this treaty and the commitments set forth within.

1. Definitions

Nazism: The ideology and practices associated with the 20th-century German Nazi Party and Nazi state, as well as other far-rightideologically related groups. In the context of NationStates, it is an ideology that glorifies National Socialism or Nazi Germany and/or actively practices Nazi beliefs such as antisemitism, pseudo-scientific racism, racial hygiene, slaughter for living space, genocide, eugenics, persecution of LGBT, etc includes advocating the practice of Nazi beliefs or glorifying National Socialism or Nazi Germany.

Nazi Region: A region recognized by CAIN as a region that practices, or has practiced, Nazism.

Nazi Collaborator: A region recognized by CAIN as a region that assists in furthering the agenda of, and/or shares core beliefs with, Nazism and/or Nazi Regions.

Signatories: The regions and organizations that sign this treaty.

On-Site Embassy: An embassy created through NationStates.

Off-Site Embassy: An embassy created on the off-site forum of a signatory region.

Inter-regional Agreement: Any treaty, accord, pact, or other agreement with another region recognized by a signatory's government as legally binding.

Military Assistance: In the context of NationStates, military assistance shall be described as Participation in raiding, defending, assisting in delegate transfersdelegate transfer assistance, or any other military action in NationStates thatwith the intention of benefitsing another region.

Host Forum: The forum selected by the signatories according to sections 2(a) and 2(b).

2. Forum Selection

(a) The initial host forum will be a dedicated area of the Europeian off-site forums.

(b) The signatories may change the host forum with a two-thirds majority vote.


3. Procedural Matters

(a) Each signatory will receive one vote in all matters considered by the signatories. A signatory's vote will be cast by the highest executive authority of that signatory, or a representative selected according to that signatory's internal processes.[note]This sentence transposes what is presently 2(l) "The highest executive authority of a signatory region, or an internally selected representative, will be recognized as that signatory's voting member for the votes mentioned in this treaty."[/note] Each signatory may assign a second representative, who can contribute to debate but may not vote.


(b) All votes mentioned in this treaty shall of the signatories will be announced at least one week in advance, unless otherwise specified in this treaty.[note]This provision transposes part of what is presently 2(m) "All votes mentioned in this treaty shall be announced one week in advance of the voting process, and shall last five days."[/note]

(c) All votes will be open for five days, unless otherwise specified in this treaty.[note]This provision transposes the remainder of 2(m) (above)[/note]

(d) In all votes, a quorum of at least one half of the signatories must vote or otherwise indicate their presence during the five-day period that the vote is open.[note]This provision transposes and alters what is presently 2(n) "In order for the voting process to take place, a simple majority of signatories must indicate their presence. Any signatory which is not present during the voting process will have their vote counted as an abstention." It requires quorum to be established during the vote, rather than prior to it, and removes deemed abstentions.[/note]

(e) If circumstances require a quick decision on a matter, the timing requirements of 3(b) and 3(c) may be waived if a motion to that effect receives the support of at least five signatories. If such a motion is submitted, a good faith method must be made to notify all signatories of the accelerated vote before the voting period closes.

(f) The votes mentioned in this treaty shall take place on the off-site forum of Europeia in a sub-forum contained next to the original treaty. This sub-forum will be Host Forum in an area restricted to legal representatives of signatories and administrators of the Host Forum.[note]This provision transposes what is presently 2(o)[/note]

4. Membership Administration

(a) Invitations to join CAIN will be issued to all regions that vote to approve this document in an initial vote.

(b)
AnyA region wishing to joinbecome as a signatory of CAIN after the initial conferencevote may do so by receiving sponsorship from two signatories must first submit an application including the recommendation of at least two signatories. Sponsored regions will then be voted on by all signatories. Should they receive a simple majority of the vote, regions must complete the requirements described elsewhere in this treaty. A majority vote of the signatories will be required to approve an application. If an application is approved, the region will receive an invitation to join.[note]This provision transposes what is presently 4(e)[/note]

(c) In order to be recognized as a signatory, regions must ratify this treaty in conaccordance with their internal laws within one month of receiving an invitation, after which, the invitation will expire and a new invitation must be obtained if the region still wishes to join CAIN. Once ratified, regions must send a legal representative to signify their acceptance of this treaty within the sub-forum of the Europeian off-site forum where the original treaty will be maintained for all signatoriesin the Host Forum.[note]This provision transposes what is presently 2(c)[/note]

(d) Any signatory may submit a petition to have another signatory removed. If the petition is approved by a three-fourths vote of the signatories, the signatory that is the subject of the petition will cease to be a signatory. This will not prevent any region from re-applying to become a signatory using the procedure provided in 4(b).[note]This provision transposes what is presently 2(k) "Any signatory may be removed as a signatory by a vote of three-fourths of remaining signatories."[/note]

5. Functions of CAIN

(a) The Host Forum will include the master copy of this treaty in an area that is publicly accessible.[note]This provision replicates the duty presently imposed by 2(c) "In order to be recognized as a signatory, regions must ratify this treaty in concordance with their internal laws. Once ratified, regions must send a legal representative to signify their acceptance of this treaty within the sub-forum of the Europeian off-site forum where the original treaty will be maintained for all signatories." and 2(o) "The votes mentioned in this treaty shall take place on the off-site forum of Europeia in a sub-forum contained next to the original treaty. This sub-forum will be restricted to legal representatives of signatories. "[/note]

(b) A document will be appended to the treaty listing Standardized Responses which signatories are encouraged but not required to use in the intended circumstances. This document may be amended by a motion receiving majority support.[note]This provision transposes what is presently 3(b) "Signatories shall append a document to the treaty, which may be amended by a motion supported by a majority of signatories. Within this document will be listed a number of Standardized Responses which signatories are encouraged but not required to use in the intended circumstances."[/note]

(c) The circumstances for which a Standardized Response shall be listed will include, but not be limited to, the following:
(i) A Nazi Region acting militarily against a signatory,
(ii) A Nazi Region participating within a military operation of a non-Nazi Region, and
(iii) A Signatory acting militarily against a Nazi Region.[note]This provision transposes what is presently 3(c) which is identical.[/note]

(d) Europeia The Host Forum shallwill maintain a list of all officially designated Nazi Regions and Nazi Collaborators alongside the originalmaster copy of the CAIN treaty.[note]This provision transposes what is presently 2(i)[/note]

(f) The signatories of this treaty shall maintain a thread on the Gameplay section of the NationStates forums in which standardized responses shall be posted. For the sake of transparency, the original treaty shall serve as the first post in this thread.[note]This provision (presently 3(f)) is omitted.[/note]

6. Rights and Duties of Membership

(a) Signatories shallwill not maintain off-site or on-site embassies with Nazi Regions.[note]This provision transposes what is presently 2(a)[/note]

(b) Signatories shallwill not enter into inter-regional agreements with Nazi Regions.[note]This provision transposes what is presently 2(b)[/note]

(c) Signatories shallwill not provide military assistance to any region officially designated as a Nazi Region.[note]This provision transposes what is presently 3(a)[/note]

(d) Signatories commit to working together, when consistent with internal policy, to oppose Nazi Regions through military means. This commitment includes, but is not limited to:
(i) Invading Nazi holdings,
(ii) Liberating regions raided by Nazi Regions, and
(iii) Defending against raids involving Nazi Regions.[note]This provision transposes what is presently 3(d) which is identical.[/note]

(e) Signatories commit to working together, when consistent with internal policy, to oppose Nazi Regions through Security Council means. This commitment includes, but is not limited to:
(i) Opposing commendation proposals of Nazi regions and players,
(ii) Cooperation on condemnation proposals of Nazi regions and players,
(iii) Supporting defensive liberation proposals for regions raided by Nazis, and
(iv) Supporting offensive liberation proposals against Nazi Regions.[note]This provision transposes what is presently 3(e) which is identical.[/note]

(f) Any signatory may nominate a region that meets the definition, as described by this treaty, to be a Nazi Region. Such nominations must be approved by a two-thirds vote of the signatories before being officially designated as such by CAIN.[note]This provision transposes what is presently 2(d) which is identical.[/note]

(g) Any signatory may nominate a region that meets the definition, as described by this treaty, to be considered a Nazi Collaborator. Such nominations must be approved by a two-thirds vote of the signatories before being officially designated as such by CAIN.[note]This provision transposes what is presently 2(e) which is identical.[/note]

(h) Any region which voluntarily participates in a military operation alongside, or possesses an on-site embassy with, a Nazi Region shall be officially designated a Nazi Collaborator.[note]This provision transposes what is presently 2(g) which is identical.[/note]

(i) Any region officially designated as a Nazi Collaborator shall be subjected to the same clauses as Nazi Regions with the exception of Section 2(g)to Sections 6(a)-(e) as if it was designated a Nazi region.[note]This provision transposes what is presently 2(h)[/note]

(j) Any region may be removed from the officially designated list of Nazi Regions or Nazi Collaborators by a vote of three-fourths of the signatories.[note]This provision transposes what is presently 2(f)[/note]

7. General Provisions

(a) Signatories recognize that signing this treaty does not make them allies of the other signatories.[note]This provision transposes what is presently 4(a) which is identical.[/note]

(b) Signatories recognize that signing this treaty does not signify political, diplomatic, or gameplay agreement with their fellow signatories except on the subject of Nazism and Nazi Regions.[note]This provision transposes what is presently 4(b) which is identical.[/note]

(c) To the extent allowed by a signatory's internal laws, this treaty is considered legally binding upon completion of the requirements described in Section 24(c).[note]This provision transposes what is presently 4(c)[/note]

(d) Should a region wish to resign as a signatory of CAIN, theyit may do so by going through the process of repealingwithdrawing from this treaty in conaccordance with theirits internal laws and disseminating a public notice of its repealwithdrawal. Such notices must be released in a way that reaches a majority of signatories.[note]This provision transposes what is presently 4(d)[/note]

(e) This treaty may be amended by a three-fourths vote of the signatories. Such amendments must then be ratified by the signatories before being considered binding. Amendments will be announced in the CAIN Gameplay thread, after which signatories have two weeks to decide whether they wish to ratify the amendment or notduly authorized entities of the signatories according to their internal law and will not be considered binding until at least two-thirds of the signatories have ratified the amendment. Once two-thirds of signatories have ratified an amendment, the remaining signatories will have two weeks to ratify the amendment.If no progress has been made on the ratification process after those two weeks the region will no longer be considered a signatory If they fail to do so, they will no longer be considered signatories. Notification will be provided to all signatories after the initial vote and once the two-thirds ratification mark has been reached.[note]This provision transposes what is presently 4(f)[/note]

(f) Any signatory may opt-out of ratifying an amendment to CAIN. After doing so, it will no longer be considered a signatory unless an exception is granted by a three-fourths vote of the other signatories.[note]This provision transposes what is presently 4(g)[/note]

(g) Any signatories that miss two votes consecutively will have their signatory status suspended until such time that they request to be returned to active status. During this suspension, they will not be counted as a signatory for clauses mentioned in this treaty.[note]This provision transposes what is presently 4(h) which is identical.[/note]

8. Enactment

On ratification, this treaty will replace all previous versions of CAIN.

The signatories of CAIN have voted to pass this amendment. It is now being sent to the legislatures of each signatory region to vote on it. Essentially, all it does, is just clear up some wording and phrasing and adds a section on a host forum. As a signatory region, the cabinet and I decided to vote for it.
