1. The State Code of Osiris will be amended to read as follows:
State Code of Osiris

Section 1: Preamble

1. We, the members of the Deshret assembled, hereby establish the Osiris Fraternal Order for the general welfare of the People of Osiris. In order to provide for the stability, security, and democratic self-governance of Osiris, we hereby establish this Code by which the Osiris Fraternal Order will be governed.

Section 2: Executive of Osiris

1. The Pharaoh will serve as the chief executive official of the Osiris Fraternal Order, representing the Osiris Fraternal Order as Head of State and administering the Osiris Fraternal Order as Head of Government.

3. The Pharaoh will have the power to eject and/or ban any nation from Osiris that is violating the endorsement limit applicable to that nation for the purpose of reducing its Soft Power Disbursement Rating. Any such ban that lasts more than one update will be subject to approval by the Deshret.

4. Any extrajudicial ejection or ban imposed against a citizen's nation will not void their citizenship for a period of thirty days, during which time they may move a new nation into Osiris for the purpose of maintaining citizenship or return the ejected nation to Osiris, if possible.

5. The Pharaoh will have the power to appoint deputies to assist in the administration of executive powers and responsibilities.

6. The Pharaoh will serve as commander-in-chief of the military forces of the Osiris Fraternal Order and will have the power to order and authorize deployments of such forces. The Pharaoh will be required to execute declarations of war and treaty obligations.

7. The Pharaoh will have the power, with the approval of the Deshret, to declare war against other regions, organizations, and groups and to declare a cessation of war.

8. The Pharaoh will have the power to negotiate treaties with other regions, organizations, and groups on behalf of the Osiris Fraternal Order for ratification by the Deshret.

9. The Pharaoh will have the power to annex other regions as sovereign territory of the Osiris Fraternal Order. Such territory will be governed according to the standards established by law.

10. The Pharaoh will have the power to sign or veto any legislation passed by the Deshret. If the Pharaoh neither signs nor vetoes legislation within seven days of its passage, it will automatically become law.

11. The Pharaoh will have the power, with the approval of the Deshret, to pardon or commute the sentence of any individual convicted of any criminal offense against the Osiris Fraternal Order.

12. The Pharaoh will have the power to approve or deny applications for citizenship, diplomatic recognition, and exchange of embassies according to the standards established by law.

Section 3: Security Council of Osiris

1. The Atef will be the security council of the Osiris Fraternal Order. The Pharaoh will appoint, with the approval of the Deshret, citizens to serve as Guardians of the Atef who will continue to serve until resignation or removal by the Deshret.

2. Should a Guardian serve as Pharaoh or Acting Pharaoh, their membership in the Atef will be suspended for the duration of their service as Pharaoh or Acting Pharaoh.

3. Guardians will be required to maintain WA nations in Osiris with high endorsement counts at all times. Guardians may exceed endorsement limits up to 66% of the Pharaoh's endorsement count.

4. The Pharaoh may at their discretion waive the Atef's endorsement limit during times of emergency and grant grace periods in regard to the Atef's endorsement limit during Pharaoh transitions. The Pharaoh may rescind such waivers and grace periods at their discretion.

5. The Vizier will serve as Vice Pharaoh of the Osiris Fraternal Order and Chief Guardian and Chair of the Atef, entitled to hold the second most endorsements in Osiris, beyond the endorsement limit for the Atef.

6. The Pharaoh will appoint, with the approval of the Deshret, a member of the Deshret to serve as Vizier who will continue to serve until resignation or removal by the Deshret or until election or re-election of the Pharaoh.

7. The Vizier will serve as Acting Pharaoh in the event of the Pharaoh's scheduled absence or an unscheduled absence exceeding seven days. The Vizier will be vested with all powers of the office of Pharaoh for the duration of the Pharaoh's absence.

8. The Acting Pharaoh will not assume the in-game WA Delegacy except in the event of an emergency as certified by the Atef.

9. Should the office of Pharaoh for any reason be vacated, the Vizier will assume the office of Pharaoh until a new Pharaoh is elected. An election for Pharaoh will be conducted as soon as practical.

10. In the event that the Vizier for any reason cannot serve as Acting Pharaoh or assume the office of Pharaoh, as detailed above, succession will pass to a Guardian who is able to serve, in descending order of their endorsement count.

Section 4: Assembly of Osiris

1. The Deshret will be the legislative assembly of the Osiris Fraternal Order, comprised of all citizens of the Osiris Fraternal Order who apply and are approved for membership by a vote of the Deshret. Any applicant who is not approved for membership will not be eligible for re-application for a period of thirty days.

2. No vote to approve applications for membership in the Deshret will begin during any election period, from the time submission of candidacies begins until final results are officially declared.

3. The Pharaoh or Acting Pharaoh will be a non-voting member of the Deshret for the duration of their term as Pharaoh or Acting Pharaoh but may vote in elections.

4. The Keeper of the Deshret will preside over the Deshret according to its procedural rules. The Pharaoh and Vizier will not serve as Keeper of the Deshret for the duration of their term as Pharaoh and Vizier.

5. The Deshret will have the power to define standards for maintenance of membership in the Deshret by law.

6. The Deshret will have the power to make and revise its own procedural rules. Such procedural rules will not be subject to the signature or veto of the Pharaoh.

7. The Deshret will have the power to pass any law that it determines is necessary and proper for the general welfare of the People of Osiris.

8. The Deshret will have the power to ratify treaties negotiated by the Pharaoh with other regions, organizations, and groups.

9. The Deshret will have the power to release sovereign territory of the Osiris Fraternal Order from the possession of the Osiris Fraternal Order by two-thirds majority vote.

10. The Deshret will have the power to override the veto of the Pharaoh by two-thirds majority vote.

11. The Deshret will have the power to remove officials from office by two-thirds majority vote and to remove deputies from their positions by simple majority vote. An appointed official or deputy, once removed, may not be re-appointed to the same position during the same term of office.

12. Unless otherwise mandated by this Code, all votes of the Deshret will be determined by simple majority vote. The result of any vote will be determined by taking into account only members who have voted and discounting any abstentions cast in the vote.

Section 5: Court of Osiris

1. The Pschent will be the judicial court of the Osiris Fraternal Order, comprised of three Elders.

2. Elders will be citizens of the Osiris Fraternal Order and will not serve in any other office or as deputy to any other office for the duration of their term as Elder.

3. Elders will elect from among their number a Chief Elder to preside over the Pschent according to its rules of order at the beginning of each term.

4. The Pschent will have the power to make and revise its own rules of order.

5. The Pschent will have the power to nullify any law or portion of law that contradicts this Code, and to order the cessation of any government action that violates this Code or the laws of the Osiris Fraternal Order. The Pschent may only exercise this power if petitioned to do so by an affected citizen of the Osiris Fraternal Order.

6. The Pschent will have the power to hear prosecution of criminal charges, to decide guilt or the lack of it, and to determine penalties for guilty parties according to the standards established by law.

7. Decisions by the Pschent amount to interpretation of the law, and such decisions and interpretations are binding upon the Pschent and upon all government institutions, offices, and officials.

8. Unless otherwise mandated by this Code, all decisions by the Pschent will be determined by simple majority vote.

Section 6: Attorney General of Osiris

1. The Advocate of the Deshret will be the attorney general of the Osiris Fraternal Order.

2. The Advocate will be a citizen of the Osiris Fraternal Order and will not serve in any other office or as deputy to any other office for the duration of their term as Advocate.

3. The Advocate will have the power to bring criminal charges before the Pschent and to prosecute such charges. The Pschent may accept charges brought by any citizen of the Osiris Fraternal Order and appoint a special prosecutor to prosecute such charges if it believes a conflict of interest will impair the Advocate's exercise of this power.

4. The Advocate will be responsible for maintaining a list of citizens willing to serve as counsel to the accused, for providing non-binding advisory opinions in response to legal questions raised by citizens, and for defending laws of the Osiris Fraternal Order against petitions for judicial review.

5. The Advocate will have the power to appoint deputies to assist them in executing their powers and responsibilities.

Section 7: Election of Officials

1. The following officials will be elected from among the membership of the Deshret and will have the following length of term:

(a) The Pharaoh of the Osiris Fraternal Order will have a term of three months.
(b) The Keeper of the Deshret will have a term of two months.
(c) Elders of the Pschent will have a term of six months.
(d) The Advocate of the Deshret will have a term of six months.

2. There will be no limit to the number of terms any elected official may serve.

3. Elections for Keeper will be administered by the Pharaoh. Elections for all other elected offices will be administered by the Keeper.

4. In the event that any designated electoral administrator is standing for office in the election they are designated to administer or the office of the electoral administrator is vacant, administration of that election will pass to the most senior member of the Deshret who is not standing for that office and is available to serve as electoral administrator.

5. An electoral administrator will not vote in the election they are administering except in the event of a tie.

6. All elected officials will be elected by plurality vote of the Deshret.

Section 8: Admission to Citizenship

1. For the purposes of this Code, citizens will be defined as applicants who have been admitted to citizenship by the Pharaoh or designated executive deputy according to the standards established by law.

2. Minimum requirements for an applicant to attain citizenship are as follows:

(a) No applicant for citizenship will be admitted to citizenship if the applicant does not have a nation residing in Osiris.

(b) No applicant for citizenship will be admitted to citizenship if the applicant is a member of any region, organization, or group that has declared or engaged in war against the Osiris Fraternal Order, or against which the Osiris Fraternal Order has declared war, until the cessation of war or until the applicant has renounced membership in said region, organization, or group.

3. Additional requirements for admission to citizenship in the Osiris Fraternal Order may be established by law.

Section 9: Rights of Citizenship

1. Citizens will have the right to be secure in their citizenship according to the standards established by law.

2. Citizens will have the right to be secure against ejection and/or ban from Osiris except as a temporary measure to enforce lawfully and publicly established World Assembly (WA) endorsement limits or to reduce the Soft Power Disbursement Rating of any nation that violates such endorsement limits.

3. Citizens will have the right to determine their WA status, to be secure against requirement to provide endorsement to any nation, to be secure against any specialized endorsement limit below the general endorsement limit, and to be secure against punishment for endorsing any nation which has a number of endorsements below the endorsement limit that is applicable to that nation.

4. Citizens will have the right to be secure against unlawful ban from the Osiris Fraternal Order forum. A citizen's forum access may be temporarily limited to the Pschent subforum for the duration of criminal proceedings.

5. Citizens will have the right to freedom of speech and expression, subject to reasonable restrictions imposed by law which do not violate the spirit of this Code.

6. Citizens will have the right to stand for, vote for, and be appointed to public office provided they meet eligibility requirements imposed by law.

7. Citizens will have the right, during all criminal prosecutions, to be informed of the cause of the action against them, and will enjoy a presumption of innocence until proven guilty.

8. Citizens will have the right, during all criminal prosecutions or civil disputes, to represent themselves or to be represented by counsel of their choice in fair, speedy, impartial, and public trial.

9. Citizens will have the right to be secure against double jeopardy in relation to the prosecution of criminal charges.

10. Citizens will have the right to be secure against ex post facto laws and bills of attainder.

11. Citizens will have the right to due process of law and equal protection under the law.

12. The enumeration of rights of citizenship by this Code will not be construed to restrict the enumeration of additional rights of citizenship or rights of non-citizens by law.

Section 10: Forum Administration

1. The sole legally legitimate forum of Osiris is located at the following URL: https://osiris.valthost.com/index.php

2. Nothing in this Code or other laws of Osiris will be construed to abridge the power of the forum root administrator to grant or deny administrative or moderation power over this forum as they see fit.

3. The power of forum administration and moderation to enforce the Zetaboards Terms of Service and Terms of Use and to establish and enforce additional terms of use related exclusively to forum security will supersede all other provisions of this Code and all laws of Osiris.

4. Administrative and moderation action may be reviewed by the Pschent, by petition of any citizen or on its own initiative, exclusively to determine whether the action taken was necessary for enforcement of the Zetaboards Terms of Service, Terms of Use, and/or forum security.

Section 11: Amendment

1. The Deshret will have the power, by three-quarters majority vote, to amend this Code. Amendments to this Code will not be subject to the signature or veto of the Pharaoh.

4. Administrative and moderation action may be reviewed by the Pschent, by petition of any citizen or on its own initiative, exclusively to determine whether the action taken was necessary for enforcement of the Zetaboards Terms of Service, Terms of Use, and/or forum security.

Section 11: Amendment

1. The Deshret will have the power, by three-quarters majority vote, to amend this Code. Amendments to this Code will not be subject to the signature or veto of the Pharaoh.

  • Clarified succession beyond the Vizier in Section 3.10.
  • Restricted non-voting membership only to the Pharaoh, rather than the Pharaoh and Vizier, in Section 4.2, but continued to prohibit both from serving as Keeper in Section 4.3.
  • Changed the threshold for removing all officials to two-thirds, and all deputies (including Cabinet) to simple majority, in Section 4.11.
  • Constitutionally established the Chief Elder in Section 5.3.
  • New Section 6 for an elected Attorney General, the Advocate of the Deshret.
  • New Section 7 to deal with election of officials, notably giving the Pharaoh a scheduled term rather than challenge elections. Note term lengths and electoral administration as other potential areas of discussion.
  • Split citizenship admission requirements into its own section, Section 8.
  • Cleaned up Section 9 to remove lettered sub-clauses and to separate longer clauses into separate clauses, where possible, to make them more readable.
  • Section 10 is completely unchanged.
  • Section 11 now requires only a three-quarters vote of the Deshret to amend the State Code, not subject to the Pharaoh's veto.

Omnibus Procedure Amendment Act

Section 1: Amendment

1. The Procedure of the Deshret will be amended to read as follows:
Procedure of the Deshret

Section 1: Membership of the Deshret

1. The Deshret will be comprised of all citizens of Osiris who have applied for membership in the Deshret and who have been approved according to the procedure established by the State Code of Osiris.

2. Any member of the Deshret who fails to maintain citizenship in the Osiris Fraternal Order according to the standards established by law will be removed from the membership rolls of the Deshret but will be eligible for re-application upon again attaining citizenship.

3. Any member who misses three or more consecutive votes in the Deshret without declaring an official leave of absence will be removed from the membership rolls of the Deshret but will be eligible for re-application.

4. The Deshret may, by a two-thirds vote, remove a member for conduct unbecoming of a member of the Deshret. Any member removed under this provision will not be eligible for re-application for a period of four months.

Section 2: Operation of the Deshret

1. Any member of the Deshret may introduce a proposal before the Deshret. A proposal will go to vote only after a mandatory consideration period of three days, which may be extended to seven days at the discretion of the Keeper.

2. A proposal will proceed to vote after a motion to vote on the proposal has been made by any member and seconded by any two additional members. The Keeper may at their discretion delay a vote for up to seven days if two or more proposals are already at vote.

3. Only the Pharaoh or their designated deputy may introduce treaties or agreements with other regions before the Deshret, which will follow the same process as any other proposal introduced before the Deshret.

4. Only the official responsible for such appointments may introduce appointments requiring approval by the Deshret, which will follow the same process as any other proposal introduced before the Deshret.

5. Any matter at vote before the Deshret will only pass the Deshret after a five day voting period. For a vote to be valid, a simple majority of all Councilors must cast a vote of aye, nay, or abstain/present during the voting period.

6. Members of the Deshret may vote aye, in favor of a proposal; nay, against a proposal; or abstain/present, indicating a vote neither in favor nor against but that one has participated in the vote for the purpose of retaining membership in the Deshret.

Section 3: Electoral Administration

1. The election period for any elected office will begin with a three day period for submissions of candidacy, followed by a two day period for campaigning, followed by a five day period for voting. A candidate may begin campaigning immediately upon submitting candidacy.

2. An election period will begin ten days before the expiration of an elected official's term or as soon as practical after an elected office is vacated.

3. In any election, members of the Deshret may vote for one eligible candidate who has submitted candidacy or may vote abstain/present. Votes of abstain/present will count only toward participation in the vote for the purpose of retaining membership in the Deshret.

Section 4: Keeper of the Deshret

1. The Keeper of the Deshret will be responsible for the following duties:

(a) Any and all duties assigned to the Keeper by any law of the Osiris Fraternal Order;

(b) Maintaining the membership rolls of the Deshret according to the criteria established by Section 1 of this Procedure;

(c) Executing the processes for matters introduced before the Deshret as established by Section 2 of this Procedure and for presenting legislation that has passed the Deshret to the Pharaoh for signature or veto, if applicable;

(d) Maintaining a law index that includes all legally enacted constitutional documents, statutes, treaties, agreements, and amendments to such laws;

(e) Establishing additional rules for order and other processes for the operation of the Deshret provided that they do not conflict with this Procedure or other law.

2. The Keeper will have the power to appoint deputies to assist in the execution of these powers and duties.

3. Should the office of Keeper become vacant, the most senior member of the Deshret who is available to serve will preside over the Deshret for the duration of the vacancy.
This is an amendment to the Procedure to accompany the above State Code amendment, which can be edited as we discuss the State Code amendment.

  • Added a new section, Section 3, for electoral administration. Note that the election period is extended beyond our current seven day period to a ten day period, which allows two campaigning days after nominations close and before voting, and an additional voting day.
  • Added fulfillment of the Keeper's responsibilities assigned by other laws to his duties in the Procedure, and struck the power to make cosmetic changes to the Procedure since it has never been necessary and never been used.
  • Changed the provision for a Keeper vacancy so that the most senior member of the Deshret presides during the vacancy.
  • Note that we no longer have a provision for legislative ties. A legislative tie would result in defeat of the legislation as that would not be a simple majority. This may be something we'll want to discuss.

Yes it does, and that's something we should discuss. I've maintained no term limit in this draft because the State Code currently has no term limit on any office, and we hadn't discussed changing that.

My personal view is that if the Deshret wants to continue re-electing a Pharaoh, and if a Pharaoh wants to continue serving, we shouldn't impose an artificial limit on the number of terms a Pharaoh can serve. A mandated term limit could catch us at a point of low activity when we don't have an abundance of qualified, trustworthy people who want to serve. There are compelling arguments to the contrary and I look forward to hearing them so we can discuss the merits of competing points.

It would also be good to hear acceptable term limits for both those in favor and those against as a potential compromise, should we find ourselves split on the matter. I wouldn't be comfortable with anything shorter than a three term (nine month) limit, which is close to the two term limits of other GCRs that have four month Delegate terms. My preference would be a four term (one year) limit, if we decide on term limits at all.

Regarding the positives, there wouldn't actually be fewer elections. There would still be an election every three months, even without any term limits, and the incumbent Pharaoh could be unseated by an election opponent every three months.

I agree that a lack of term limits could have the negative impacts you note. Imposing term limits could also have negative security impacts, including more Delegate turnover which could increase the potential for a coup d'etat.

I only meant it as if we had a good Pharaoh whose policies and decisions were admired/supported by the community. With unlimited term limits they could be there for some time.

For example, in TNP Mcm has served as Delegate for 8 terms. He is heavily admired and respected by his community. If it was not for the term limit in The North Pacific, he would still probably be Delegate: if he decided to run again. If we had a McM here, I cannot imagine the possible terms he may have. :P

My apologies if my clarification is not clear/or completely relevant as im new to legislating. But what im trying to say is there are many people here who have experience in leadership positions. From those people, there individuals who are admirable and have support from the citizens ,for what they believe in & what they stand for; like McM. Said individuals would dominate the Delegacy.

Coming to my second point of an Oligarchy.

During the previous discussion, we seemed somewhat split on the matter. You suggested the Deshret passing amendments and then ratification by a referendum of all citizens, Treize pointed out that keeping decision making in the Deshret and subject to the Pharaoh's veto allows us to keep requirements for maintaining citizenship low.

As a compromise, I went with a 3/4 vote of the Deshret to amend the State Code. That gets rid of the Pharaoh's veto in favor of a decision by the citizens who are in the Deshret, and the high threshold, while not a full citizen referendum, should ensure that the amendment is generally favored by the citizenry. Anything that can get a 3/4 vote in the Deshret probably isn't going to be opposed by many non-Deshret citizens either, was my reasoning. Next best thing to a citizen referendum.

I'm not strongly attached to this and only drafted it as a compromise though, so I'm fine with reverting to the Pharaoh having veto power.
