Reforms to the Scribe of Justice

Moderator: Pharaoh

What system should be used for the prosecution of offences, provision of public defenders, and issuing of non-binding legal advice in Osiris?

Reforms to the Scribe of Justice

I am not of the view that such an extension of the provision would come into being, the bill is quite clear that it singularly applies to "the Pharaoh", not to "a Pharaoh", and is in that manner similar to all of our other law that references the Pharaoh in that it assumes there is only one, not many. I'm not convinced that for this one provision an assumption would be made that runs counter to the rest of our law, perhaps if Councillors remain concerned as to such they could elaborate for me.

A possibility that I have not until lately considered is whether the provision should be extended to include the Vizier or a Guardian of the Atef, when they are serving as Acting Pharaoh, but I would like the opinions of my fellow Councillors before making such an amendment.

Acting Pharaoh has full executive authority under the law, so I see no difference. As for the provision the simple addition of the word sitting in a few places would suffice I think to answer both points.

In the future it would be helpful to show exactly how amendments are changing existing law by physically demonstrating that with scored language for eliminated clauses and bold for new additions. It wasn't until post #18 did I fully grasp exactly what it is we were talking about and even getting to that point, I now have to put the existing legislation side by side with the proposed measure to identify exactly where the changes are being made and how they effect law already on the books.

Now that I've introduced myself as the prickly, uppity guy the newer people don't know and are now annoyed by...I'll go back to my corner.

Reforms to the Scribe of Justice

I'm not entirely sure that my confusion on the point of former Pharaohs has been understood, my point was more that I don't see why the provision would be construed to extend to former Pharaohs, it doesn't seem like an extension that could be made, to me, as our current law refers only to a single Pharaoh (whoever holds the office at the time) and does not make provision for Pharaohs Emeritus, so the elaboration I was seeking was as to why such an extension might be made.

With regards to acting Pharaohs, my main concern is that while there is an acting Pharaoh, the Pharaoh themselves does remain in office and the acting Pharaoh does not assume the office per se but rather its powers (though not the delegacy), so there is a lack of clarity in this respect, to me. If my fellow Councillors think that I am incorrect then I shall yield to the collective wisdom of this place.

(At the request of Councillor CSP, above, I have edited my earlier post to include the current law, annotated with the changes that would be made by the Bill (though not quite in the format he requested))

I have noted that this bill has been motioned to vote. Do I see a second?

While I have enjoyed the discussion I do feel that the proposal put forward just isn't really optimal. I feel as if it would serve to add another layer of red tape to what would already be a sticky situation.

a few what if scenarios for your consideration

The term ends during a trial, the defendant is no longer the Pharaoh. Does the trial continue?
The Deshret votes to remove the Pharaoh during the trial and again the defendant is no longer the Pharaoh. Does the trial continue?
The Pharaoh resigns before the trial starts, do we still hold a trial?
The accusations come out a month after the Pharaoh who allegedly committed the crime has left office, do we still hold a trial?
The Pharaoh has just begun his term and the alleged crimes were committed 6 months prior before they even considered running for office.

While I am confident that these various logistical questions can be resolved I would like to see them resolved before we proceed to a vote.

I suggest tabling for a time.
