[Defeated] Citizenship Oversight Amendment Act

I have significantly edited this draft, as the Pharaoh's constitutional revision proposal and further discussion have made some parts of the original draft unnecessary or undesirable. The new draft, which is in the OP, would create a simple appeals process for approved or rejected citizenship applications to be appealed to the Council of Priests. There is no longer any provision for further appeal to the Council of Scribes.

The new draft in the OP should not be moved to vote unless and until the constitutional revision proposal passes, as this may be unconstitutional according to the current language of the Scroll of Ma'at. It is also possible I won't be moving forward with this at all, should it be included in some kind of omnibus amendment to the Legal Code after passage of the constitutional revision. But it's posted here for discussion until we see what happens with those amendments.

Citizenship Oversight Amendment Act Section 1: Amendments to the Scroll of Ma'at

(1) Article I, Section 1(2) of the Scroll of Ma'at will be amended as follows:
Current Text wrote:(2) The Pharaoh is responsible for approving or rejecting citizenship applications within seven days of filing. Citizenship applications neglected for more than seven days will automatically go to vote before the Council of Guardians.
Amendment Text wrote:(2) The Pharaoh is responsible for approving or rejecting citizenship applications within seven days of filing. Procedure for neglected citizenship applications and an appeals procedure for approved or rejected citizenship applications may be established by law.
(2) Article I, Section 2(3) of the Scroll of Ma'at will be amended as follows:
Current Text wrote:(3) The Pharaoh may, with the approval of the Council of Guardians, impose suspension or revocation of citizenship to preserve the security and stability of Osiris. The Pharaoh may exercise this power during a regional state of emergency without the approval of the Council of Guardians.
Amendment Text wrote:(3) The Pharaoh may, with the approval of the Council of Guardians, impose suspension or revocation of citizenship to preserve the security and stability of Osiris. An appeals procedure for citizenship suspended or revoked in this manner may be established by law.
Section 2: Amendment to the Legal Code of the Osiris Fraternal Order

(1) The following amendment to the Legal Code of the Osiris Fraternal Order may only be enacted if the amendments to the Scroll of Ma'at contained in this Act are also enacted.

(2) The following will be amended into the Legal Code of the Osiris Fraternal Order as Article I, Section 1(6)-(10):

Citizenship applications neglected by the Council of Guardians for more than seven days will automatically go to vote before the Council of Scribes.
(7) Citizenship applications rejected by the Pharaoh may be appealed to the Council of Guardians by the applicant within seven days of rejection. Citizenship applications approved by the Pharaoh may be appealed to the Council of Guardians by any citizen within seven days of approval.
(8) Citizenship applications rejected by the Council of Guardians may be appealed to the Council of Scribes by the applicant within seven days of rejection. Citizenship applications approved by the Council of Guardians may be appealed to the Council of Scribes by any citizen within seven days of approval. Applicants rejected by the Council of Scribes may not reapply for citizenship for a period of three months.
(9) Applicants whose citizenship applications are under appeal will not be admitted to citizenship until the window for further appeal has expired. Applicants already admitted to citizenship prior to appeal being filed will be suspended from citizenship upon filing of an appeal, until the window for further appeal has expired.
(10) Citizens whose citizenship has been revoked pursuant to Article I, Section 2(3) of the Scroll of Ma'at may appeal revocation of citizenship to the Council of Scribes within seven days of revocation. Revocation of citizenship, if under appeal, will not be implemented unless and until upheld by the Council of Scribes.
What this legislation does:
  • Amends the Scroll of Ma'at to allow establishment of procedure for neglected, approved, and rejected citizenship applications by law, so that we can stop amending the constitution every time we need to tweak something, which is something the Pharaoh has expressed he would like to see stop because it gives the impression of instability.
  • Provides for applications neglected by the Council of Guardians to go before the Council of Scribes. We currently have no process for if an application is neglected for a week by the Council of Guardians, only if neglected for a week by the Pharaoh.
  • Provides an appeals process for rejected citizenship applicants to appeal to the Council of Guardians, and then finally to the Council of Scribes. An applicant once rejected by the Council of Scribes can't reapply for three months, which is a built-in disincentive to flippantly using this final appeal so it won't be overused.
  • Provides an appeals process for any citizen to appeal an approved citizenship application to the Council of Guardians, and then finally to the Council of Scribes, so that citizens who are unhappy with someone admitted to citizenship have recourse to see that decision overturned.
  • Provides an appeals process for any citizen whose citizenship is revoked by the Pharaoh with the approval of the Council of Guardians to appeal that revocation to the Council of Scribes.
  • Removes the power of the Pharaoh to unilaterally revoke citizenship during a state of emergency. Such revocation would still be subject to appeal to the Council of Guardians during the state of emergency, as well as to the Council of Scribes when the state of emergency concludes.
Basically, this is legislation to affirm that admission to citizenship is admission to full participation in our community, and that revocation of citizenship is removal from full participation in our community, and as such the institution that directly represents our community -- the Council of Scribes -- should be the final point of appeal for such decisions. Not too controversial, I hope.
