It should remain part of the Executive, in my view. It's fine for an executive department to prosecute the accused.

It would still remain with the Hedjet since its role is mainly the prosecution of those who would violation Osirian law.

[Draft] State Code of Osiris

Here is it is, plus a few changes to the draft of the state code I made. I still would want to propose a couple of things, but I'll wait for the others to comment first.
State Code of Osiris

Preamble

We, the Councilors of the Deshret and the Scribes of the Hedjet, with the consent of the Pharaoh of Osiris, on behalf of the People of Osiris and for their general welfare, hereby establish the Osiris Fraternal Order. In order to provide for the stability and security of Osiris and the efficient operation of her government, we hereby establish this State Code of Osiris by which the Osiris Fraternal Order will be governed.

Article I: Pharaoh of Osiris

1. The Pharaoh of Osiris shall serve as the chief executive officer of Osiris, representing Osiris as Head of State and administering Osiris as Head of Government.

2. The Pharaoh shall hold the in-game World Assembly (WA) Delegacy, will have the power to set a general endorsement limit for Osiris, and will have the power to enforce all endorsement limits.

3. The Pharaoh shall have the power to appoint and remove Scribes of the Hedjet and with the approval of the Deshret.

4. The Pharaoh shall have the power to organize the executive branch of government and to delegate executive powers and duties.

5. The Pharaoh shall serve as commander-in-chief of the military forces of Osiris and will have the power to order and authorize deployments.

(a) The Pharaoh shall be required to execute declarations of war and treaty obligations.

6. The Pharaoh shall have the power to negotiate treaties with other regions or organizations on behalf of Osiris for submission to the Deshret.

7. The Pharaoh shall have the power to sign or veto any law passed by the Deshret. No law, treaty, declaration, or other document passed by the Deshret will have the force of law without the signature of the Pharaoh.

8. The Pharaoh shall have the power to pardon or commute the sentence of any individual convicted of any criminal offense against Osiris.

9. The Pharaoh shall have the power to approve or deny applications for citizenship, diplomatic recognition, and exchange of embassies at his discretion.

10. The Pharaoh shall appoint a Vizier to serve as Vice Delegate of Osiris, holding the second most WA endorsements in the region.

(a) The Vizier of Osiris shall serve as acting Pharaoh in the event of the Pharaoh's absence.

11. The Pharaoh will appoint the Atef of Osiris to serve as the security council of Osiris. Guardians of the Atef will be required to maintain WA nations in Osiris with high endorsement counts at all times.

(a) Guardians of the Atef may only exceed the general endorsement limit up to 66% of the Pharaoh's endorsement count or ten endorsements less than the Vizier's endorsement count, whichever is lower.

(b) The Pharaoh may at his discretion waive the Atef's endorsement limit during times of emergency and grant grace periods in regard to the Atef's endorsement limit during Pharaoh and Vizier transitions. The Pharaoh may rescind such waivers and grace periods at his discretion.

12. The Pharaoh shall have the power to select his own successor with the approval of the Deshret.

Article II: Deshret of Osiris

1. The Deshret of Osiris will be the legislative council of Osiris, open to all citizens of the Osiris Fraternal Order who maintain active involvement in the executive branch of government as certified by the Vizier.

(a) The Pharaoh and the Vizier shall be given non-voting, advisory membership in the Deshret and may not serve as Keeper of the Deshret.

2. The Deshret will elect from among its Councilors a Keeper of the Deshret. The Keeper will serve a two month term as the presiding officer of the Deshret.

3. The Deshret shall have the power to make and revise its own procedural rules.

4. The Deshret shall have the power to pass any law that it determines is necessary and proper for the general welfare of the People of Osiris. The Deshret shall also have the power to override a Pharaoh's veto by two-thirds vote of all its members.

5. The Deshret shall have the power to declare war against other regions and organizations.

6. The Deshret shall have the power to ratify treaties negotiated by the Pharaoh of Osiris with other regions and organizations.

7. Unless otherwise noted by this Code, all decisions by the Deshret will be made by simple majority vote.

Article III: Kenbet of Osiris

1. Judicial power shall be vested in the The Kenbet of Osiris. The Kenbet shall be composed of three Elders appointed by the Pharaoh with the approval of the Deshret, who shall serve in good faith until public resignation or impeachment by the Deshret. Elders of the Kenbet shall not serve in any other branch or instrumentality of government.

2. The Kenbet shall have the power to make and revise procedural rules for the resolution of any judicial matter, provided that such are not contrary with the State Code of Osiris.

3. The Kenbet shall have the power to hear prosecution of alleged criminal and other offenses, to decide guilt or the lack of it, and to determine sentences for guilty parties within the limits established by law. The Kenbet shall also have the power to determine whether there has been a grave abuse of discretion amounting to lack or excess of jurisdiction on the part of any branch of government or instrumentality thereof.

4. All decisions by the Kenbet shall be made by simple majority vote. If the Kenbet should however, so decide to overturn a previous ruling it has made, after much consideration of the matter, a unanimous vote is needed.

Article IV: Amendment

1. The Deshret shall have the power, by two-thirds vote and with the concurrence of the Pharaoh, to amend this Code.

So far i like it but there is one thing i have to say The pharaoh appoints his own successor dont you think that goes against a democratic government we are trying to build here? should the citizens choose who they bilieve should be pharaoh? if this has been already been discussed i apologize i have been at work all day pretty much and tired but i bilieve we should have a more democratic system more regions will look at us more positively while still maintaining a strong monarch thats my opinion on the matter.

I've stated before that I am firmly in favour of democratic methods, and that hasn't changed. The challenge system is one possible method.

I would be fine with a challenge system. I'm also open to Cere's suggestion though, and would like to see that fleshed out a bit more, as well as giving time for other options to be brought up.

If we go with a separate judiciary, how do others feel about removing Deshret confirmation of Scribes? The primary reason I had Scribes being confirmed in the draft was their judicial role.
